Terms & Conditions

BY SUBSCRIBING TO OUR PARKING SERVICES, YOU AGREE TO THE TERMS & CONDITIONS SET OUT BELOW. IF YOU DO NOT ACCEPT THESE CONDITIONS, IMMEDIATELY TERMINATE OUR SERVICES AND LEAVE ANY OF OUR DIGITAL PORTALS, SOCIAL MEDIA PAGES, AND THE PARKING SITE.

1. These Terms & Conditions apply from the moment that you subscribe to our parking services and/or drive your vehicle into this parking site and apply 24 hours a day, 7 days a week. You also bind the owner of the vehicle you are driving to all these Terms & Conditions and warrant your authority to do so.

PAYMENT AND BREACH OF THESE TERMS & CONDITIONS

2. You agree to the following rules:

(a) You must comply with all rules or directions displayed in the parking site from time to time and with all relevant laws.

(b) You must not obstruct other persons or vehicles using the parking site.

(c) You must not park in any area marked “RESERVED” or “NO PARKING” or outside of the line-marked parking spaces.

(d) You must not park in space over the stipulated parking time.

(e) The vehicle you are parking in this parking site must be in safe working order, be roadworthy and be always able to be driven under its power, and not present any danger or risk to other vehicles or persons or the parking site.

(f) You must pay in advance for your parking space every month from the date start parking.

(g) Lost parking pass will be charged at the rate of RM50 per pass.

(h) Parker will have to pay fines upfront in case of disputes and an appeal is to be made in writing to SRIPROP DIGITAL SDN. BHD. and/or R & A Selatan Jaya via email. Outcomes will be determined only after investigations by SRIPROP DIGITAL SDN. BHD. and/or R & A Selatan Jaya.

3. If you contravene clauses 2 (a) to (g) of the above Terms & Conditions, you agree that we may apply a wheel clamp to your vehicle and/or remove your vehicle by having it towed at your own risk and expense and we may hold the vehicle until all outstanding debt has been paid. If we apply a wheel clamp to your vehicle or have it towed, you agree that your vehicle will only be released upon payment of the release fee and payment of any outstanding debt. The clamping fee will be charged at RM100.00 per day.

RESPONSIBILITY FOR DAMAGE

4. You are liable for any damage to the parking site properties and vehicles caused by you or your vehicle.

5. While we shall take all responsible care, we cannot guarantee the security of your vehicle. We accept no liability for any claim by you or any other person, whether for loss or damage to you or any other person or your vehicle or any other vehicle, whether resulting from using the parking site or being able to use the parking site or from your negligence or otherwise.

6. We accept no liability for any loss or damage to any article left in our custody or control. Notwithstanding anything to the contrary contained in this document, our employees are not authorized to accept any of your possessions for safe custody except for the keys to your vehicle where possession is taken at your request. Further, you agree to indemnify us in respect of any claim made against us arising from your use of the parking site or use of the parking site by anyone else with your authority.

MISCELLANEOUS

7. In the event of a lost parking pass or damage to any equipment or property, you must provide us with your full name and address, contact number, and vehicle registration number when requested by us.

8. If we fail to act or pursue any right or remedy available to us this will not in any way prejudice our right to exercise that or any other right or remedy.

9. No one is authorized to amend these Terms & Conditions on our behalf.

INTERPRETATION

10. To avoid any confusion as to the meaning of these Terms & Conditions:

(a) “claim” includes any claim for damage, loss, or compensation, and any damage or demand.

(b) “damage” includes direct, indirect, consequential, and special damage.

(c) “outstanding debt” includes previous unpaid parking fees and/or unpaid enforcement notices.

(d) “vehicle” includes its accessories and contents.

(e) “Company”, “we” and “us” means JBParking / SRIPROP DIGITAL SDN. BHD. / R & A Selatan Jaya and/or includes any of its employees, agents, partners, and independent contractors.

(f) “you” includes both the driver and the owner of a vehicle entering this parking site.

(g) “your vehicle” means both primary and secondary vehicles which you are driving and parking in the parking site, regardless of whether they are owned by you.

(h) “parking site” means the parking site you are subscribing to for parking services which are managed by JBParking for online marketing and owned by R & A Selatan Jaya.

(i) “notice” means Parking Enforcement Breach Notice.

MONTHLY PARKING SUBSCRIPTIONS

 11. Definitions and interpretation in these Terms & Conditions:

(a) “amount payable” means the parking fee, administration fee, and/or any other monies payable following these Terms & Conditions;

(b) “Company” includes its successors and assigns and, where applicable, its employees, agents, partners, and contractors;

(c) “Parker” includes each person who parks a vehicle in the parking site under these Terms & Conditions and, to the extent applicable, each passenger of that vehicle; and

(d) “access materials” means any form of pass or identification issued by the Company from time to time including a pass check, parking pass, window pass, windscreen sticker, and monthly pass.

(e) “parking fee” means the parking fee payable to the Company monthly in advance as described in Clause 2 below.

(f) “Monthly Parker” means the Parkers who pay their parking fee monthly in advance to the Company.

12. Parking Fees & Charges:

(a) The parking fee is payable to the Company monthly in advance or as otherwise advised from time to time. Any other relevant amount payable is also payable to the Company in advance or as otherwise advised from time to time.

(b) The Company may vary the parking fee or other charges at any time by giving existing Parkers one (1) month’s written and/or digital notice of the variation.

(c) If any new fee becomes payable in respect of the provision of parking in the parking site, the Company may give the existing Parker one (1) months’ notice of that fee and at the expiry of that notice period, the Parker must pay the amount of that fee in respect of each vehicle the subject of these Terms & Conditions.

(d) Payment for monthly parking is calculated on a monthly billing cycle as stipulated for each parking space and commences on the 1st day of the month to which the billing cycle relates. No pro rata or proportionate allocation of fees will be applied or refunded for any unused portion of the billing cycle, irrespective of when payment is made.

(e) Failure to renew and make payment before the expiry date for all Monthly Parkers will result in an administration fee of RM50.00 for the deactivation and reactivation of parking passes. If you have entered the parking site using a parking pass and subsequently renewed your monthly parking, you will not be allowed to leave the parking site using your access materials without first paying the fee accrued for entering the parking site using a parking pass. No rebates or refunds will be provided to you for such payment, nor will you have your parking pass validated for free. Please note that reminders are not obligatory, but courtesy, and each Monthly Parker oversees their account/s. We will not take responsibility for Monthly Parker not receiving any reminder WhatsApp messages and/or emails either in their email box or junk email box.

(f) An additional administration fee of RM100.00 for each billing will be imposed for manual monthly parking payment collection e.g., cheque, cash security deposit, telegraphic transfer, or any other methods that do not utilize our selected payment gateways such as RMS, MEPS FPX, or RHB Now/Reflex.

(g) If you do not reactivate your access materials due to late payment within two (2) weeks from the expiry date, your account will be terminated, and you will need to submit a fresh monthly parking application to us. An RM50.00 charge will be imposed for the Reactivation of every monthly pass.

(h) I hereby agree to accept electronic receipt from SRIPROP DIGITAL SDN. BHD. and/or R & A Selatan Jaya for billing record-keeping purposes. All amounts shown on the receipt shall be due and payable as stated.

(i) For monthly parking applicants, refunds for parking passes will only be refunded the day after payment is made regardless of the Start Date chosen i.e. if the Start date is 1st January but payment is received on 5th January, then parking passes will only be refunded from the 6th January onwards until your parking access material is delivered to our parking site counter for your collection.

Please note that if a Monthly Parker makes payment before the Start Date, there will be no refunds for parking passes if the access material has already been delivered to the parking site counter on or before the Start Date and remains uncollected by the Parker.

Note: No refunds for passes can be proceeded with if the parking original receipts have not been scanned and WhatsApp/emailed to us. Parking Original receipts with the vehicle registration number written on the back of the receipts MUST also be handed to our parking site counter for any refunds to proceed.

(j) If the Monthly Parker cannot gain entry to the parking site for valid reasons whatsoever due to no fault of their own, SRIPROP DIGITAL SDN. BHD. and/or R & A Selatan Jaya will only reimburse the Parker upon production of the original receipt up to a maximum of RM10 subject to evidence being provided by the Monthly Parker and at the sole discretion of SRIPROP DIGITAL SDN. BHD. and/or R & A Selatan Jaya.

13. Denial of Access

(a) The Company is entitled to deny the Parker access to the parking site if any amount payable remains unpaid after the due date.

(b) If the Parker is found to have violated the terms & conditions of entry and conduct to the parking site, the Company reserves the right to terminate the parking privileges.

(c) In the case of multiple access materials in a simple account, all materials and/or passes will be denied access if any amount payable remains unpaid after the due date.

14. Additional Parking

(a) These Terms & Conditions will apply to any additional parking spaces in the parking site provided by the Company to the Parker.

(b) Any additional parking granted above the agreed permanent allocation will be temporary and may be withdrawn upon receipt of one (1) month’s termination written notice by the Company via WhatsApp message and/or email.

15. Termination

(a) The monthly parking may be terminated by either party giving one (1) month’s written notice by WhatsApp message and/or email to the other at any time.

(b) The Company may terminate the monthly parking of all related accounts of the Parker immediately if the Parker is in breach of these Terms & Conditions.

(c) A 7-day money-back guarantee scheme is provided to all new Parkers and they may terminate their monthly parking subscriptions by sending written notice to the Company via WhatsApp message and/or email. Upon receiving the notice, the Company will process the termination and the balance of unused parking days fees of the month will be refunded to the Parker within 7 days.

(d) No refund or rebate will be provided to any after 1st 7 days of Parkers for termination of their monthly parking subscriptions.

(e) If a Parker has lost his/her access material/pass and has paid for a replacement access material/pass, no refund or rebate will be provided to the Parker if he/she subsequently finds or recovers the lost access.

(f) Any verbal abuse, physical threat, or intimidation of any kind whatsoever to our staff, will result in an immediate termination of monthly parking.

(g) Any Monthly Parker found guilty of allowing other Parkers to use their access materials/passes to enter or exit the parking site is in breach of our Terms & Conditions. The Parker’s account will be terminated immediately, and their access materials/passes confiscated. There will be no refunds for any unused balance. Additionally, depending on the severity and number of breaches and violations, the Monthly Parker may be banned from using the services of the parking site.

16. Parking Space Allocation

(a) Unless otherwise agreed by us, the Parker will not have exclusive use of any parking space.

(b) Guaranteed space means allocating space for Monthly Parkers from the entire parking site. Monthly Parkers are welcome to park in any available space of their choosing within the parking site.

(c) The RESERVED space is allocated for special subscribing Parker only. Other than the designated special subscribing Parker’s vehicle which is registered with the Company, other vehicles parked in a designated RESERVED space will be wheel clamped and a fine of RM100.00 per day will be imposed if no prior written notification of a change of Parker’s vehicle registration number is provided to the Company.

(d) The Parker with RESERVED space shall not allow other vehicles to park in such RESERVED space except for Parker’s vehicle which has been registered with the Company.

17. Duties of the Parker

(a) Allow the Company access to any part of the parking site at any time to inspect it, do any necessary repairs, or for any other purpose specified by the Company;

(b) Observe and conform to all the rules and regulations relating to the use of the parking site issued by the Company from time to time;

(c) Use the parking site only during its operating hours as varied from time to time; and

(d) Where the monthly parking relates to more than one space, maintain records of the relevant access materials and corresponding parker details, and make them available to the Company when requested.

(e) Enter the parking site only with Parker’s access material. No refund or rebates will be provided, or validation of parking will be accepted if Parker does not enter the parking site using Parker’s access material. The Parker must pay for any parking pass used to enter the parking site before being allowed to leave the parking site.

(f) All fines will have to be paid upfront to SRIPROP DIGITAL SDN. BHD. and/or R & A Selatan Jaya and an appeal by Parker (if any) is to be made via WhatsApp message and/or email. Outcomes will be relayed to the Monthly Parker after investigations have been conducted by SRIPROP DIGITAL SDN. BHD. and/or R & A Selatan Jaya.

18. No Safe Custody

(a) No employee, agent, partner, or contractor of the Company has the authority to accept any goods for safe custody and the Company will not be liable in any case for any loss of or damage to any article alleged to have been left with the Company or any employee, agent, partner, or contractor for safe custody regardless of how that loss or damage is caused.

19. Alteration of Terms and Conditions

(a) The Company reserves the sole right to vary these Terms & Conditions by adding, altering, or deleting any of them without prior notice and it is your responsibility to check on these Terms & Conditions on the website which is displayed on www.jbparking.com.my.

20. Waiver

(a) No time or other indulgence granted by the Company to the Parker will constitute a waiver of any of its rights under these Terms & Conditions or at law and the Company will not be precluded from exercising any such rights against the Parker.

21. Relationship

(a) Nothing in these Terms & Conditions create or will be construed as creating any tenancy or conferring any interest upon the Parker by way of lease or otherwise in the parking site or any part of it.

22. Assignment

The monthly parking is personal to the Parker and the Parker must not assign any rights or obligations under the monthly parking without the prior written consent of the Company.

23. Customer Vehicle Assistance

(a) If, at the request of the Parker, the Company provides any form of vehicle assistance to the Parker, including but not limited to re-charging the battery of Parker’s vehicle:

(i) The Parker accepts such assistance at Parker’s own risk in all respects; and

(ii) If any damage is caused to Parker’s vehicle, the Parker releases and indemnifies the Company from and against any claim which the Parker may otherwise have against the Company in respect of that damage.

24. Conditions of Entry and Limitation of Liability

(a) The Terms & Conditions of entry and limitation of liability displayed at the entrance to and throughout the parking site are incorporated in these Terms & Conditions and apply to these Terms & Conditions as if they were set out in full.

(b) In the case of any inconsistency between these Terms & Conditions and the Terms & Conditions of entry and limitation of liability, these Terms & Conditions will prevail.

25. Miscellaneous

(a) You confirm that you have read, understood, and agreed to the Customer’s Data Protection Policy.

26. Service of Notices for Bills, Statements, Reminders, and any Communication.

(a) The Company assumes no responsibility for any non-delivery of notices for bills, statements, reminders, and/or any communication. All notices for bills, statements, and/or reminders, and/or any communication shall be deemed to have been duly delivered in any of the following manners:

(i) By WhatsApp and/or email, by properly inputting Parker’s WhatsApp number and/or email address on record and noting that the WhatsApp message and/or email has been sent out without any delivery failure notification.

(ii) The Parker must communicate with the WhatsApp number and/or email address which they registered with the Company. The Parker is advised to check his mailbox (including Junk/Spam box) for any emails sent by the Company.

(iii) The Parker must immediately notify the Company if there are any changes to their WhatsApp number and/or email address.
